Waiver
It is necessary for each volunteer ('the Volunteer', 'I', 'me' or 'you') involved in a Property Industry Foundation ('the Foundation') event ('the Event') to read and sign this Volunteer Statement of Waiver ('Waiver')
This Waiver is not intended to be a legally binding contract between the Foundation and Volunteer, and it may be cancelled at any time by either the Foundation or Volunteer.
As a Volunteer, you are not an employee of, or contractor to, the Foundation. By signing this Waiver you acknowledge you perform all duties on a voluntary basis and will not receive remuneration or payment for your volunteer work.
VOLUNTEER RESPONSIBILITIES
1. Volunteers must:
a) Attend the safety briefing relevant to the Event either prior to or on the day of the Event;
b) provide any information required by the Foundation relevant to their role before or on the day;
c) abide by all instructions given by the Event staff and the Foundation Event manager /
organisers;
d) notify Event staff or the Foundation Event manager of any health and safety issues or potentially hazardous situation that may pose a risk to you or others and report any accident or incidents relating to staff, volunteers or the workplace; and
e) behave appropriately and courteously to all participants in the Event, Foundation staff and the public while volunteering; and comply with the law at all times, including the relevant health and safety laws.
2. The Foundation reserves the right to cancel aspects of, or the entire Event in circumstances that place the participants at the Event or Volunteers at risk, such as inclement weather. The Foundation has complete discretion to cancel the Event.
HEALTH AND SAFTEY
3. The Foundation has safety obligations towards Volunteers and a duty of care to minimise the risk of injury. However, you may be personally liable for any harm or damage caused to yourself or others if:
a) you act outside the Volunteer role description;
b) you act outside the instructions given to you by Foundation staff or Volunteers; or
c) you are affected by drugs or alcohol when you are volunteering.
4. As a Volunteer of the Foundation, you also have health and safety duties. These include:
a) taking reasonable care for your own health and safety;
b) taking reasonable care for the health and safety of others;
c) letting the Foundation know of any concerns you may have about safety or fitness in performing your role; and
d) cooperating with any reasonable rules, policies and procedures of the Foundation in relation to health and safety.
PERSONAL LIABILITY
5. You may be personally liable for any harm or damage caused to yourself or others if:
a) You act outside the Volunteer role description;
b) You act outside the instructions given to you by Foundation staff or the Event organisers; and / or
c) You are affected by drugs or alcohol when you are volunteering.
VOLUNTEER STATEMENT OF WAIVER
6. You acknowledge that the Foundation or the Event Organisers shall not be liable for any direct or indirect loss or damage to you caused by your conduct including:
a) death; or
b) a physical or mental injury (including the aggravation, acceleration, or recurrence of such an injury).
INSURANCE
7. The Foundation has the following insurances:
a) Volunteer workers insurance
8. To be covered by the Foundation's insurance policies, you must:
a) Sign in and sign out on the volunteer register with the Foundation Event manager on the day of the Event.
b) Report any incident that occurs at the Event as soon as it has occurred with the Foundation Event manager.
WORKERS COMPENSATION
9. Whilst volunteering, you will not be covered by the Foundation's workers' compensation insurance policy.
GENERAL ACKNOWLDGEMENTS BY VOLUNTEER
10. I will attend the formal safety briefing prior to the start of the Event, and acknowledge it is my responsibility to listen to and understand the directions given at this briefing.
11. To the extent permitted by law, I understand and acknowledge that I am responsible for my own conduct.
12. I authorise and consent to the Foundation or the Event organiser's staff and representatives or other medical personnel providing medical care or transporting me to a medical facility as considered necessary for my health. I agree to pay all costs associated with medical treatment and transportation for medical treatment.
13. I am fully responsible for the security of my personal possessions at the Event and neither the Foundation or the Event organiser is responsible for the replacement of any personal possessions.
14. I will not use or disclose any confidential information relating to the Foundation for any purpose other than the proper discharge of my duties as a Volunteer.
STATEMENT OF WAIVER
15. To the extent permitted by law, I hereby expressly waive all my rights to sue the Foundation in respect of death or personal injury arising as a result of any volunteering activities provided by to Foundation.
ACCEPTANCE
16. I have read and accept the Volunteer Responsibilities, Health and Safety, Release and Indemnity, Insurance, Workers Compensation, General Acknowledgements and Statement of Waiver above.
17. I confirm that the details entered below are true and are that of the individual (or the individual responsible for the minor) submitting this Waiver.

PRIVACY COLLECTION STATEMENT
The purpose of collecting your personal information is to enable the Foundation and the Event organiser to process your application as a Volunteer. Your personal information will not be disclosed to any other party or used in any other way unless you have provided consent for the Foundation to do so.
CONSENT TO USE IMAGES
I consent to the use by the Foundation of any photograph or image of me taken during the Event for marketing or promotional purposes. I understand that all ownership and copyright in the images will be owned by the Foundation.
I grant the Foundation permission for the perpetual and ongoing use of the images. I understand and acknowledge that the images may be published, exhibited, or reproduced for use on different platforms and mediums, including but not limited to website, social media and for any other purpose reasonably required by the Foundation in the conduct of its business. If you wish to opt out from being included in any Event photography, you may withdraw your permission by notifying the Event manager in writing.
